ViOL Secures Patent Win at ITC (International Trade Commission) in U.S.

 

 

 

 

The medical aesthetic device company ViOL has won a preliminary ruling in a patent infringement lawsuit

concerning microneedle radiofrequency (RF) core technology at the U.S. International Trade Commission (ITC).

This victory officially recognizes the uniqueness and value of ViOL's technology, further solidifying its position in the global market.

 

ViOL filed lawsuits against five North American companies—Cutera, Cynosure, Cartessa Aesthetic, Aesthetic Biomedical,

and Endymed—and nine companies, including Lutronic, Ilooda, and Jeisys Medical, in South Korea.

Of these, ViOL reached settlements with eight companies, excluding Endymed.

Endymed, which refused to settle and awaited the lawsuit's outcome, was also found to have infringed on ViOL's patent in the ruling.

 

ViOL is considering filing a second patent infringement lawsuit based on this success.

A company representative stated, "We are conducting an in-depth review of companies excluded from the first lawsuit,

and this ruling places us in a favorable position for a second lawsuit." 

Industry experts suggest that companies such as InMode could be included in future lawsuits.

However, ViOL has maintained a cautious stance, stating, "No specific companies have been identified yet."

 

ViOL's U.S. subsidiary, Serendia LLC, spearheaded the lawsuit.

Serendia LLC holds the patent for ViOL's core microneedle technology and manages its distribution within the United States.

 

ViOL, in collaboration with Serendia LLC, is reviewing additional cases of potential patent infringement.

If a second lawsuit proceeds, it is expected to significantly reshape the microneedle RF market landscape.

The industry is closely watching ViOL's next steps, as its actions will likely majorly impact the sector.
